Exemptions From Providing Security Information

In order for an exemption from that requirement to be granted, the shipowner or the shipowner's representative shall submit a written application together with a filled in and signed form (see the appendix) to the Ship Supervision Department of the Estonian Maritime Administration (EMA).

The application shall contain the following information:

•     name of ship;
•   the scheduled service to which the exemption is applied for;
•   name of the person submitting the application.

The EMA will process applications regarding ships that comply with Article 6 of Regulation (EC) No. 725/2004 and with the requirements of Annex 2 of Circular Letter of the EMA No. 5-1-7/3 of 27 May 2019. In case of a positive response from all Member States involved the EMA shall forward this information to the shipowner or the shipowner's representative in writing.

The exemption applies only in case the requirements of Article 7 of Regulation (EC) No. 725/2004 are met. If the ship alters the service that it operates (the route), the shipowner shall submit a new application for exemption from the requirement of provision of security information and the ship shall provide security information in accordance with the requirements. An exemption applies on the condition that the ship has a valid international ship security certificate and security level 1.

In accordance with Article 7.3 of Regulation (EC) No. 725/2004, the EMA shall periodically check that the conditions for exemption from provision of security information are being met. Where these conditions are no longer being met, the privilege of the exemption shall be withdrawn and the ship shall provide security information in accordance with the requirements. In such case, a new application for exemption can be submitted after 3 months.
